The B.C. Court of Appeal has dismissed a challenge to the so-called bubble-zone law aimed at protecting women's access to abortion clinics in the province.
Donald David Spratt and Gordon Stephen Watson mounted the constitutional challenge after they were convicted of violations under the Access to Abortion Services Act in August 2000.

Spratt and Watson were convicted because they protested within an "access zone" prohibited under the law outside a Vancouver abortion clinic. They carried signs and spoke against abortion to women entering and leaving the Everywoman's Health Centre, which first opened in 1988 and had been a continuing target of anti-abortionists.
The men appealed to the B.C. Supreme Court, but their case was dismissed in May 2002. Two years later they made their case to the Appeal Court on the grounds that the bubble zone law violated their rights of freedom and expression under the Charter of Rights.
The B.C. Court of Appeal ruling on Thursday said that while the right to oppose abortion is constitutionally protected, the purpose of the provincial law to protect vulnerable women and those who provide for their care justified limiting protesters' rights.
"The purpose or objective of the [Access to Abortion Services] Act is sufficiently important to justify a limitation on the way in which freedom of expression is exercised in an area adjacent to the facilities providing abortion services," it said.
The B.C. government enacted the law in June 1995, seven months after a Vancouver doctor who performed abortions was shot in his home and almost died. The bubble zone is an area within a 50-metre radius of a facility where anti-abortion protesters are not allowed.
Spratt and Watson said on Thursday the court's decision fails to protect free speech in B.C.
"You just heard a judge say you don't have freedom of speech in British Columbia — that's what that means," Watson said.
"Basically it means you have a two-tier system of justice," Spratt said. "If you're a profiler or an unborn baby in this society your rights mean nothing."

So, we have an election Oct. 14/08. How fun!!!!
For the record, just because I have a blogger tag called conservative party of Canada, doesn't mean I love them. In fact my perspective of them would have more in common with a metaphor, a wolf in sheeps clothing and the wolf and I certainly do not get along. According to the latest poll, they are going to get a majority government in which case I will not be pleased. There is a reason why they have not been in power in the last 15 years. They are usually a bunch of hot-heads who believe in 19th century values such as pro-life, but due to the ruling by the Supreme Court of Canada in 1988, they havn't been able to fulfil that dream. They also have no plans for improving the environment but that is not surprising as some of their biggest donors are big oil companies. The party is also known for some very obvious political theatrics. Most recently, P.M. Harper was photographed taking one of his kids to school after the summer break. It is a nice thing for a dad to do and I am not attacking that, however, if you're trying to play up your family values which is what the religious right lives for, then it was a wonderful photo-op. By the look on the child's face, he was not pleased to see the cameras. You can tell by the tone of this blog, I am not a fan of the conservatives. I never have been and most likely, never will be. I will slam the the conservatives and throw my support behind any other party in Canada but I will never tell you which one.

About 30 Toronto police officers will be stationed in high schools this fall, Toronto District School Board chairman John Campbell said yesterday.
The school resource officers will have offices in high schools, both Catholic and public, but will also visit and look after middle schools in nearby areas, he said. They will be in full uniform, which includes a gun.
Mr. Campbell said the officers and students will be able to develop day-to-day relationships, which he hopes will deter violent acts and keep students on track.
The officers will be reallocated from other assignments, and will not be paid from school board budgets. Officials in nearby regions, such as Kitchener-Waterloo, London and Ottawa, have also stationed officers in schools, he said.

Although the following article is about Air Canada Jazz removing life jackets, other carriers such as Porter Air also have the option of carrying or not carrying life jackets - it is at their own discretion. OTTAWA - An Air Canada regional affiliate has dumped life vests from its aircraft as a cost-cutting measure, a move critics say is going too far for the sake of saving money.
"The reason for making the decision was to remove duplication aboard our aircraft because, of course, with the high cost of fuel, we're looking at everything," said Air Canada Jazz spokeswoman Manon Stuart. "On board Jazz aircraft we used to carry both the flotation device, which is the seat cushion, as well as life vests."
In case of an emergency over water, passengers will now rely solely on the flotation device (their seat!). The airline will also carry infant life vests on all aircraft.

Transport Canada regulations require an aircraft travelling beyond 50 nautical miles - about 90 kilometres - from shore to carry a life preserver for each person on board. If the aircraft is within that distance from the shore, there is the option for airlines to use either a flotation device or the live vests.
Jazz had to adjust its routes only minimally to ensure all flight stayed within the appropriate distance from shore, Stuart added.
"We operate over 880 flights everyday through 85 destinations throughout North America. We had to adjust only two routes out of all of our entire network," she said.
Transport Canada spokeswoman Maryse Durette said the change has been approved by the department.
"What Jazz used to offer, which was the life preserver on top of the flotation device, was extra," said Durette.
But critics suggest the decision is a case of over zealous cost-cutting.
"To say the passengers are first is I think a bit of a misnomer," said Woodrow French, the mayor of Conception Bay South, N.L, who has been advocating for an airline passenger bill of rights along with Liberal MP Gerry Byrne.
"I think in this decision that's been made by Jazz, passengers are a distant second to profits," added French. He said it doesn't make sense to remove safety equipment from an aircraft.
"If you've got five fire extinguishers aboard the aircraft, are you going to take two off because Transport Canada says you only need three?" he asked.
The move also drew criticism from Michael Janigan, the executive director of the Public Interest Advocacy Centre, a consumer interest group.
He said airlines have been reducing costs related to passenger comfort - for example, charging for blankets, headphones and extra baggage - but it goes beyond that now.
"It's clear that they've turned their attention to expenses that are not simply . . . applicable to the comfort of their passengers," he said. "This is now in the area of air passenger safety itself."

Air Jazz removes life vests from flights, critics call it 'over zealous cost-cutting'

OTTAWA - An Air Canada regional affiliate has dumped life vests from its aircraft as a cost-cutting measure, a move critics say is going too far for the sake of saving money.
"The reason for making the decision was to remove duplication aboard our aircraft because, of course, with the high cost of fuel, we're looking at everything," said Air Canada Jazz spokeswoman Manon Stuart. "On board Jazz aircraft we used to carry both the flotation device, which is the seat cushion, as well as life vests."
In case of an emergency over water, passengers will now rely solely on the flotation device (their seat!). The airline will also carry infant life vests on all aircraft.

Transport Canada regulations require an aircraft travelling beyond 50 nautical miles - about 90 kilometres - from shore to carry a life preserver for each person on board. If the aircraft is within that distance from the shore, there is the option for airlines to use either a flotation device or the live vests.
Jazz had to adjust its routes only minimally to ensure all flight stayed within the appropriate distance from shore, Stuart added.
"We operate over 880 flights everyday through 85 destinations throughout North America. We had to adjust only two routes out of all of our entire network," she said.
Transport Canada spokeswoman Maryse Durette said the change has been approved by the department.
"What Jazz used to offer, which was the life preserver on top of the flotation device, was extra," said Durette.
But critics suggest the decision is a case of over zealous cost-cutting.
"To say the passengers are first is I think a bit of a misnomer," said Woodrow French, the mayor of Conception Bay South, N.L, who has been advocating for an airline passenger bill of rights along with Liberal MP Gerry Byrne.
"I think in this decision that's been made by Jazz, passengers are a distant second to profits," added French. He said it doesn't make sense to remove safety equipment from an aircraft.
"If you've got five fire extinguishers aboard the aircraft, are you going to take two off because Transport Canada says you only need three?" he asked.
The move also drew criticism from Michael Janigan, the executive director of the Public Interest Advocacy Centre, a consumer interest group.
He said airlines have been reducing costs related to passenger comfort - for example, charging for blankets, headphones and extra baggage - but it goes beyond that now.
"It's clear that they've turned their attention to expenses that are not simply . . . applicable to the comfort of their passengers," he said. "This is now in the area of air passenger safety itself."

TORONTO, Aug. 20, 2008 (Canada NewsWire via COMTEX News Network) -- Maple Leaf Foods today announced it is voluntarily expanding a recall of packaged meat products manufactured at its Bartor Road (Establishment No. 97B) facility in Toronto, as a precautionary measure, as they may be contaminated with Listeria monocytogenes.
Consumption of food contaminated with Listeria monocytogenes may cause listeriosis, a foodborne illness. Elderly, the very young, pregnant women and people with weakened immune systems are particularly at risk.
A small number of Sure Slice packaged meat products produced at the Company's Bartor Road, Toronto facility, predominantly for foodservice customers, have tested positive to contain low levels of listeria monocytogenes. The Company has initiated a voluntary recall of these products, and as a precautionary measure expanded the recall to include all products produced on the two manufacturing lines involved from June 2nd (the earliest affected production date) to present. The Company is also temporarily closing the plant in order to fully reassess all aspects of its food safety procedures at this facility, including supplementary sanitation of equipment and validation of our testing protocols.
"We believe it is important to take these broader preventative actions to respond to this situation promptly, comprehensively, and in the best interests of our consumers," said Maple Leaf Consumer Foods President Rick Young. "We have a strong culture of food safety that these incidents do not uphold, and we are taking every step required to maintain our very high standards."
Sure Slice Roast Beef and Sure Slice Corned Beef products were involved in a recall announced on Sunday, August 17. Additional products now being recalled include the following, and were largely distributed to foodservice institutions such as restaurants, hospitals and nursing homes and may also be sold at deli counters supplied by foodservice distributors. The retail products affected were distributed nationally.
The products being recalled all carry Establishment No. 97B and have a best before date up to and including those identified in the table below. <<

3 Canadian soldiers killed in Afghanistan

Three Canadian soldiers were killed in southern Afghanistan after a roadside bomb detonated near their vehicle Wednesday morning, the Canadian military said Thursday.

Karl McKay/DND)The soldiers were conducting a patrol in the volatile Zhari district in Kandahar province when an improvised explosive device exploded around 10:30 a.m. local time, Brig.-Gen. Denis Thompson said at a news conference late Thursday morning in Kandahar.
Sgt. Shawn Eades, 33, was identified as one of the fallen soldiers. The military has not released the names of the other two at the request of the families. A fourth soldier was also injured and is in serious but stable condition.
The three soldiers were members of the 12 Field Squadron, 1 Combat Engineer Regiment based in Edmonton and were attached to the 2nd Battalion Princess Patricia's Canadian Light Infantry battle group while in Kandahar.
Thompson described Eades as a veteran soldier well-respected by all for his "outstanding professionalism and his operational experience and his competence."

Sgt. Shawn Eades was a combat engineer with 12 Field Squadron, 1 Combat Engineer Regiment from Edmonton, Alberta. (DND)Eades, a father, was on his third tour in Afghanistan. Interviewed before departing for the country in 2005, he told CBC News: "We are just raring to go. We've been basically building up to this point for the last 3½ months. We just want to get going, get working on our job and come home."
Lisa Eades told the Canadian Press that it was her husband's dream to help people by serving in the military and that he believed strongly in the Afghanistan mission.
She said he had strong values and relished his family, his military comrades and especially his two young daughters, who are seven and four.
The three soldiers were part of a tight-knit crew of combat engineers who were en route to a site to survey a route for use in a future operation, said Thompson.
"As combat engineers, they were proud, resourceful and armed with the technical knowledge that they generously used to assist the mission in helping the people of Kandahar province," said Thompson.
Deadly month for foreign troops
The latest deaths come during a deadly month for both Canadians in Afghanistan and foreign troops stationed in the war-torn country as part of the NATO-led International Security Assistance Force.
Ten French soldiers died Tuesday in a gun battle near the capital, Kabul, in the largest single loss of life for any of the international forces engaged in combat in Afghanistan in more than three years. Three Polish soldiers also died Wednesday in the central Ghazni province.
Word of the Canadian deaths came as troops gathered in Edmonton for the funeral of another soldier killed in Afghanistan earlier this month, Master Cpl. Erin Doyle.
Doyle, of B.C., died Aug. 11 when insurgents attacked his combat outpost in the Panjwaii district in the province of Kandahar.
His death came two days after Master Cpl. Josh Roberts of Saskatchewan was killed in a firefight with insurgents in Zhari district.
On Aug. 13, two Canadian aid workers were shot dead when insurgents ambushed their SUV in Afghanistan's eastern Logar province. Jacqueline Kirk of Montreal and Shirley Case of Williams Lake, B.C., were killed, along with Trinidadian-American aid worker Nicole Dial and the group's Afghan driver, Mohammad Aimal.
Taliban more aggressive: Thompson
Thompson said the string of deaths are not a sign that the Taliban are gaining strength, but acknowledged they have become more aggressive.
He said roadside bombs planted by the Taliban, which account for many foreign soldier fatalities, inflict casualties, but don't indicate that the Taliban are holding that ground.
"They're not holding any of the ground that they attack us on," he said.
"So really the net effect is zero, other than it whittles away at our resolve," said Thompson, but added that it is not affecting Canadian soldiers who remain resolved to continue the mission.
With the latest three deaths, the number of Canadian soldiers killed in Afghanistan has now risen to 93. Canada launched its Afghan mission in February 2002, and about 2,500 Canadian soldiers are now serving in the war-torn country, most of them in the volatile south.With files from the Canadian Press
