DES-7-08 IN THE MATTER OF Mohamed Zeki Mahjoub
Summary: Redacted reasons for order were released today on a preliminary motion with
respect to the admissibility of information relied on by the Ministers. Mr. Mahjoub seeks
to have excluded from the record information that is believed on reasonable grounds to
have been obtained as a result of the use of torture or cruel, unusual or degrading
treatment or punishment. The Court concludes that there are reasonable grounds to
believe that some evidence on the record was obtained by the use of torture and is
therefore inadmissible.
**
These reasons are a redacted version of confidential reasons for order issued on June 9,
2010. They have been prepared subsequent to litigation relating to redactions and are
available in English only. Delay of the issuance of these interlocutory reasons for order
would be prejudicial to the applicant by unduly delaying the proceeding. A French
language summary of the conclusions is available. A certified translation will be
provided at the earliest possible time.
